InsuredMine eSign Disclosure and Consumer Consent

This InsuredMine eSign Disclosure and Consumer Consent (“Disclosures”) shall constitute due Consumer Disclosures under United States Electronic Signatures in Global and National Commerce Act (“ESIGN”), and the Uniform Electronic Transactions Act (“UETA”) and contains important information regarding the use of electronic signatures and transactions through the InsuredMine eSign service.

This document shall be applicable to all transactions and documents executed by each end user (“You” or “Your”) on the platform (https://www.insuredmine.com/) that is owned and operated by InsuredMine Inc. (“InsuredMine”) with respect to the services provided by each authorised insurance agency on the platform (“Sending Party”).

Please read these Disclosures carefully, as it outlines Your rights, obligations, and the legal framework under which electronic transactions are conducted by InsuredMine.

1. Intent to Sign Electronically/Digitally:
Subject to these Disclosures, You unconditionally intend to sign documents through the InsuredMine eSign service by means of an electronic process, attached to or logically associated with all such agreements, contracts or other records that are executed or adopted between You and the Sending Party.

2. Consent to Electronic Transactions:
By proceeding with electronic transactions and utilizing the InsuredMine eSign service, You consent to conduct business electronically, receive electronic notices and disclosures, and use electronic signatures in place of traditional paper documents.

3. Voluntary Participation:
Your participation in the InsuredMine eSign service is entirely voluntary. You have the option to choose electronic transactions or continue using traditional paper-based methods.

4. Withdrawal of Consent:
You retain the right to withdraw your consent for electronic transactions at any time. Should You choose to do so, You may revert to receiving paper documents for your transactions from the “Sending Party” with prior notice. The “Sending Party” may apply a charge for requesting paper copies that shall be notified to You through InsuredMine, electronic mail, or such other communication methods.

5. Scope of Consent and association with records:
Your consent encompasses all electronic transactions, notices, disclosures, and documents related to all Your transactions with the “Sending Party”.

6. Access and Retention:
You acknowledge that You have the necessary technology and capabilities to access and retain electronic documents and disclosures provided through the InsuredMine eSign service. You may also download, store, and print these documents for Your records.

7. Hardware and Software Requirements:
To engage in electronic transactions with the Sending Party through InsuredMine, You are responsible for ensuring You have access to a standards-compliant web browser that supports HTTPS protocol, HTML, and cookies. Certain documents may require additional software, such as a PDF viewer (e.g., Adobe Reader).

8. Notification of Changes:
In the event of any modifications or changes to the terms and conditions governing electronic transactions, InsuredMine will promptly notify You.

9. Contact Information and Requests:
For requests related to paper copies of documents, withdrawal of consent, or updates to Your contact information, please contact the “Sending Party” through telephone, postal mail, or email. Provide Your full name, email address, telephone number, postal address, and specify the nature of Your request.

10. Legal Validity and Enforceability:
You acknowledge and understand that electronic signatures and transactions facilitated through the InsuredMine eSign service hold legal validity and enforceability in the United States of America, and such other countries that these Disclosures may apply to in relation to the electronic transactions between You and Sending Party.

11. Governing Law and Jurisdiction:
The parties hereby irrevocably and unconditionally submit to the jurisdiction of the state courts of [●] and to the jurisdiction of the United States District Court for the District of [●] for the purpose of any suit, action or other proceeding arising out of or based upon these Disclosures, (b) agree not to commence any suit, action or other proceeding arising out of or based upon these Disclosures except in the state courts of [●] or the United States District Court for the District of [●], and (c) hereby waive, and agree not to assert, by way of motion, as a defense, or otherwise, in any such suit, action or proceeding, any claim that it is not subject personally to the jurisdiction of the above-named courts, that its property is exempt or immune from attachment or execution, that the suit, action or proceeding is brought in an inconvenient forum, that the venue of the suit, action or proceeding is improper or that these Disclosures or the subject matter hereof may not be enforced in or by such court.

12. Documentation of Consent:
Your consent to electronic transactions and usage of electronic signatures is recorded and retained as part of your transaction history through InsuredMine eSign.

By continuing with the InsuredMine eSign service, You indicate Your understanding of and agreement to the terms outlined in this eSign Disclosure and Consumer Consent document. This electronic signature service is offered on behalf of the “Sending Party”, providing a secure platform for electronic transactions, notices, disclosures, and electronic signatures. If You choose not to proceed electronically, please contact the “Sending Party” to explore alternative transaction methods.

Your adherence to these terms contributes to the security and legal compliance of Your electronic transactions. Please retain a copy of this disclosure and consent for Your personal records.
